Terms of service

1. Agreement

These terms are an agreement between you and avaliuser ("avaliuser", "we", "us"). They cover the website at avaliuser.xyz, the dashboard, the terminal app, our Discord bot and our Discord server (together, the "Service"). By signing in or using the Service you agree to these terms, our privacy policy, our refund policy and our acceptable use policy. If you don't agree, don't use the Service.

2. Who can use it

You must be at least 13 years old, and old enough to use Discord where you live. If you're under 18, you need a parent or guardian's permission to buy a plan, and they agree to these terms for you.

3. Your account

You sign in with your Discord account. You're responsible for everything done through it, so keep your Discord account secure. One person, one account. Don't make extra accounts to get more free trials, and don't sign in to someone else's account.

If your Discord account is banned, deleted or you lose access to it, you may lose access to your keys too. We can't move keys between Discord accounts except where we choose to, at our discretion.

4. What the Service does

avaliuser checks public pages and public interfaces of third-party sites, like Roblox or TikTok, to estimate whether a username is in use. Results are information only. We don't register, reserve, buy, sell or transfer usernames, and we don't guarantee that a name marked open can be registered. Sites change how they work, hold names from deleted or banned accounts, and block names they choose to. You're responsible for checking the result on the site itself before relying on it.

avaliuser isn't affiliated with, endorsed by or sponsored by Discord, Roblox, TikTok, Telegram or any other site it checks. Their names are used only to say which site a result is for.

5. Keys, plans and payment

• A plan gives you a key with a set number of checks, or no check limit for Unlimited. One check is one username on one site.
• Keys are tied to the Discord account they were made for. They can't be shared, sold or transferred.
• Plans are one-time purchases, not subscriptions. Checks don't expire while the Service is running and your account is in good standing.
• Prices are shown before you pay and may change at any time. A change doesn't affect a plan you already bought.
• Payments are handled through the method our staff give you. You're responsible for any fees your bank or payment provider charges.
• Unlimited means no check limit on your key. It doesn't remove the per-run limits or the fair use rules in the acceptable use policy.

6. Refunds

All sales are final. Our refund policy explains why and lists the few cases where we'll fix a problem, like a duplicate charge. Opening a chargeback or payment dispute without contacting us first breaks these terms.

7. Rules

You must follow our acceptable use policy. In short, don't use the Service to break the law or another site's terms, to impersonate or harass anyone, to take over accounts, or to overload the Service or the sites it checks. You're responsible for following the terms of every site you claim a username on.

8. Your content

The names you check, proxies you upload, custom sites you add and webhook links you save are yours. You give us permission to store and use them only to run the Service for you. You confirm you're allowed to use any proxies you upload.

9. Our Discord server and Verify

When you sign in or press Verify, you allow our app to add you to Discord servers on your behalf. We use this only to add you to the avaliuser server, or to a replacement server if ours is raided, deleted or otherwise lost. You can take this permission back at any time under Authorized Apps in your Discord settings.

10. Our property

The Service, including its code, design, name and logo, belongs to us. You may not copy, resell, reverse engineer or make a competing product from it, or remove our notices. The terminal app is for your own use and may not be shared.

11. Suspending and ending access

You can stop using the Service at any time and delete your account from the Plan & key page. We can suspend or ban your account, turn off your keys, or remove you from our Discord server if you break these terms, if your use puts the Service or others at risk, or if the law requires it. If we ban you for breaking these terms, you lose any checks left and don't get a refund.

We may change, pause or stop offering any part of the Service, including support for any site. If we shut the whole Service down for good, we'll give at least 30 days' notice on the website and in our Discord server where we can.

12. No warranty

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no promises of any kind, including that it will be accurate, uninterrupted, error free or fit for a particular purpose.

13. Limit of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special or consequential loss, or for loss of usernames, profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

14. Indemnity

If someone makes a claim against us because of how you used the Service or because you broke these terms, you agree to cover our reasonable costs from that claim, to the extent the law allows.

15. Changes to these terms

We may update these terms. When we do, we change the date at the top. For important changes we'll also post in our Discord server. If you keep using the Service after a change, you accept the new terms.

16. Law

These terms are governed by the laws of the country where the operator of avaliuser lives, without regard to conflict of law rules. Nothing here takes away rights you have under consumer protection laws where you live that can't be changed by agreement.

17. Everything else

If part of these terms can't be enforced, the rest still applies. If we don't enforce something straight away, we can still enforce it later. You can't transfer these terms to anyone else. We can transfer them if avaliuser changes hands. These terms, with the policies linked above, are the whole agreement between us about the Service.
